Agreement to Terms
Please read these Terms of Service carefully before using the American Medicare Council website. By accessing or using our Site, you agree to be bound by these Terms of Service and all applicable laws and regulations. Medicare Eligibility

The information and tools on our Site are designed to help individuals understand Medicare options, but using our Site does not guarantee Medicare eligibility or enrollment. You are responsible for determining your own eligibility and meeting all requirements established by federal law and CMS regulations.

Interactive Tools and Calculators
We offer interactive tools and calculators to help users understand Medicare concepts and compare options. These tools include but are not limited to the Medicare Penalty Calculator, Medigap Plan Finder, Medicare Cost Calculator, State Resource Directory, Open Enrollment Action Plan, Medicare Enrollment Checklist, Medigap Comparison Chart, and Prescription Drug Worksheet.
These tools provide estimates and general information based on data you input. Results are approximate and educational in nature. We do not guarantee the accuracy of tool results, and you should not rely solely on these tools for important Medicare decisions. Agent Connection Services
We connect users with licensed insurance agents and brokers who can provide personalized Medicare guidance and assistance with plan enrollment. When you submit your contact information through our forms, we share that information with licensed insurance professionals who may contact you to discuss your Medicare needs.
These agents are independent contractors or employees of independent insurance agencies. They are not employees of the American Medicare Council, and we do not control their conduct, advice, or recommendations. We receive compensation when users enroll in Medicare plans through agents we connect them with, as disclosed in our Disclaimer.
Email Communications
When you provide your email address, we may send you educational materials, newsletters, Medicare updates, and information about our services and those of our partners. You can opt out of marketing communications at any time by using the unsubscribe link in our emails or contacting us directly.
User Accounts and Access
Currently, our Site does not require user account registration for access to most features. However, we use browser local storage technology to remember your access permissions after you submit your email address through our tool access forms.
Access Tokens
When you submit your email address to access our Medicare tools, we store an access token in your browser’s local storage. This token allows you to access all eight of our interactive tools without re-submitting your email on subsequent visits. This access is tied to your specific browser and device.
You can clear this access token at any time by clearing your browser’s local storage or cache. If you use a different browser or device, you will need to submit your email address again to gain access to the tools on that browser or device.
Account Security
If we implement user accounts in the future, you will be responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Acceptable Use Policy
You agree to use our Site only for lawful purposes and in accordance with these Terms. You agree not to use our Site in any way that violates any applicable federal, state, local, or international law or regulation.
Prohibited Activities
You specifically agree not to engage in any of the following prohibited activities:
Fraudulent or Deceptive Conduct. You may not provide false, inaccurate, or misleading information to us, to insurance agents, or during the Medicare enrollment process. You may not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
Unauthorized Access. You may not attempt to gain unauthorized access to any portion of our Site, other users’ accounts, computer systems, or networks connected to our Site through hacking, password mining, or any other means. You may not probe, scan, or test the vulnerability of our Site or any network connected to the Site, or breach security or authentication measures.
Interference and Disruption. You may not interfere with or disrupt the operation of our Site or servers or networks connected to the Site. You may not introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material. You may not attempt to interfere with, compromise, or disrupt the integrity or performance of the Site or its content.
Automated Access and Scraping. You may not use any robot, spider, scraper, or other automated means to access our Site for any purpose without our express written permission. You may not use any device, software, or routine that interferes with the proper working of the Site. You may not bypass any measures we may use to prevent or restrict access to the Site.
Commercial Exploitation. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our Site, use of our Site, or access to our Site for any commercial purpose without our express written permission. You may not use our tools, calculators, or content for commercial purposes or redistribute them to others.
Intellectual Property Infringement. You may not use our Site in any manner that infringes, misappropriates, or violates any intellectual property rights or other rights of any third party. You may not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from any content on our Site.
Harmful Content. You may not submit, post, or transmit through our Site any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
Spam and Unsolicited Communications. Enforcement

Limited License

This indemnification obligation will survive termination of these Terms and your use of the Site. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
Termination and Suspension
We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Site, with or without notice, for any reason or no reason, including without limitation if we believe you have violated these Terms or engaged in conduct that we determine to be inappropriate or harmful to us, other users, or third parties.
Effect of Termination

Binding Arbitration
If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Exceptions
Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies for small claims court in the jurisdiction where you reside. Additionally, either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Governing Law and Jurisdiction
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the United States and the state of [Your state], without regard to its conflict of law principles. We shall not be liable for any failure or delay in performance of our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
